Swinburne Student Experience survey

‘Swinburne Student Experience survey' (The Promotion) Terms & Conditions are subject to the following terms and conditions:

 

  1. Promoter

Swinburne Student Amenities Association (The Promoter) and is located in John St, Hawthorn VIC 3122 (ABN 35 117 060 232) ‘and is a declared “community and charitable organisation” under the Gaming Regulation Act 2003 (registration no. 46359)’.

 

  1. Terms and conditions of entry

By filling out this survey being a current Swinburne University student, the entrant accepts these Terms and Conditions of entry.

 

  1. Who can enter
    1. The Promotion is governed by the laws of the state of Victoria, Australia. Applications are open to all students enrolled at Swinburne University of Technology. Employees of Swinburne, their relatives and members of their households (whom may be unrelated) are not eligible to apply.  Any eligible entrant who, in the opinion of The Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process will be ineligible to win.
    2. Entrants under 18 years of age must obtain the prior permission of their parent or legal guardian in order to be able to enter. The Promoter may require any such entrant’s parent or legal guardian to sign a release at The Promoter’s discretion in which the parent or legal guardian accepts responsibility for the acts and forbearances of the winner. The release will include the parent or legal guardian’s full name, address and telephone number.

 

  1. How to enter
    1. Entrants must fill in the 'Swinburne Student Experience survey’ found at https://swinuw.au1.qualtrics.com/jfe/form/SV_eUMkuDcUHd7wXUG?jfefe=new

and  provide  their  student number after completion of the survey

    1. The Promoter accepts no liability for any applications that failed to successfully process due to technical difficulties associated with the entry mechanism, Illegible and/or incomplete applications will not be accepted.

 

  1. Judging Criteria

41 (41 ) winners will be chosen from a random draw of entries received in accordance with these terms and conditions. The draw will be performed via an impartial online random draw generator at Swinburne University of Technology (Hawthorn Campus) by 21/10/2022

 

  1. Dates of promotion
    1. The promotion commences on 29/09/2022 and concludes on 11/10/2022 (“Promotional Period”). Any

entries received after the close date will not be considered. The winners will be drawn by 21/10/2022 at

10.30 am AEDT. Winners will be contacted within 24 hours of the draw.

    1. The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, The Promotion with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision
 

of The Promoter in all matters under its control is final and binding and no correspondence will be entered into.

 

  1. Promotion Winnings
    1. One (1) Giftpay giftcard valued at $1000 (The First Prize) will be awarded at the conclusion of the promotion period. The Prize will be awarded electronically.
    2. Forty (40) Giftpay giftcards valued at $50 each (The Second Prizes) will be awarded at the conclusion of the promotion period. The Prize will be awarded electronically.

7.2. The Prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.

    1. If the Prize is not claimed by 5.00 pm AEDT one week from the date the individual winner is notified (6.1), the winner’s entry will be deemed invalid and the Promoter reserves the right to conduct further draws starting the following day at 12.00 pm AEDT at the same location as the original judging as are necessary to distribute the prizes. In this event, no compensation will be given by The Promoter to the original winner. If any redrawn prize is not claimed by 5.00 pm AEDT one week from the redraw the prize will be forfeited.

 

  1. Eligible applications
    1. Entries are only available to students enrolled at Swinburne University of Technology during the time of the promotion period. By submitting an entry, the applicant warrants that it has the power and capacity to agree to these terms and conditions of entry.  The applicant agrees that where necessary, it has taken the opportunity to have independent advice in accepting the terms and conditions of entry into the Promotion.
    2. Applications will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, incomprehensible or applications that do not meet the entry requirements will be deemed invalid. No responsibility will be taken for lost, late or misdirected applications.
    3. The Promoter reserves the right to validate and check the authenticity of any application before awarding the prize by asking for proof of student ID.
    4. Applicants are not eligible to win more than one prize for The Promotion.
    5. Students are only eligible to enter the draw once. Students who enter multiple times will not be eligible for a prize (7.1 & 7.2)

 

  1. Personal information
    1. All entries become the property of the Promoter. The Promoter collects personal information in accordance with the Privacy Policy. The Promoter’s Privacy Statement can be found

at http://www.swinburne.edu.au/privacy/. To facilitate the applicant’s entry, the Promoter may disclose applicants personal information to other companies associated with this promotion. If you do not provide your personal information, The Promoter will not be able to enter you into this promotion.

    1. The winners may be required to take part in promotional activity related to The Promotion and the winners shall participate in such activity on The Promoter’s reasonable request. The wi nner consents to the use by The Promoter and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner's voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by The Promoter and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering The Promotion, all entr ants consent to the same.

 

  1. Promoter rights reserved
    1. The Promoter’s decision in relation to any aspects of the Student Experience Framework Survey is final and binding on every person who enters and no correspondence will be entered into.
    2. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for funding lost or corrupted once funding transferred is complete.
    3. The Promoter reserves the right in its sole discretion to disqual ify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other
 

improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.  The

Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

    1. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the application process.
    2. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests , natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

 

  1. General
    1. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
    2. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of applications.
